Terms and Agreement

      

Marine Engine Services (MES)  User Club Agreement

  

1. You represent that you are of legal age in country in which you enter this agreement. The User Club is void where prohibited by law. MES employees and their immediate family members and individuals living in the same household as such employees are not eligible to participate in the User Club either as a referring customer or a referred friend.

  

2. You will conduct yourself in an ethical and legal manner

  

3. When making referrals, you must comply with all applicable laws (including laws relating to privacy, protection of personal information, and unsolicited commercial communications) and community standards and do not infringe or violate the rights (including intellectual property, industrial property, moral, privacy and publicity rights) of any person. You must personally know your referrals, and they must have consented to your use of their personal information (email and name) for MES.

  

4. Rebate:

   

a. If you agree to and comply with the Terms and Agreement, MES will pay you a rebate for the first order (before tax) placed on the MES web-store system by a referred friend, up to a maximum total. Your maximum will depend on your total purchase (before tax) placed on the MES web-store system. Therefore, your rebate may change as the amount you purchase changes, or as you refer more new customers to MES. Your rebate will be noted in your account.  And deposited into the credit card  registered in your account?

  

b. Any rebate generated from referrals become available only after the order return period has expired (40 days).

  

c. Any rebate generated from referrals is applicable only to the User Club member who made the referral; rebates are non-transferable to other User Club members.

  

d. You agree that you have third party authorizations and consents necessary to allow you to provide MES with information and authorize us and other persons to act on and disclose your information as required to provide you with Services and in accordance with this Agreement.

  

5. You understand these Terms and Agreements may be changed or supplemented at times in our (MES) discretion, regarding your future use of this website and User Club. You may not change or supplement this Agreement in any manner. You indicate binding agreement and understanding of, without limitation or qualification, to be bound by the revised Agreement, by using the Websites or services after any revisions. Any modifications will be posted on our website. If you find any changes unacceptable, your only alternative is to terminate this agreement and cease to participate in the User Club.

  

6. You understand and agree that you cannot use the name of Marine Engine Service Ltd. or its trademarks, designs, or similar identifying material relating to us without express written permission from Marine Engine Service Ltd. You will remain fully responsible for any oral and/or written statements or representations made regarding MES products. The Websites may not be copied, imitated, reproduced, republished, modified, mirrored, transmitted in any way, whole or in part without prior written consent. You will not use any of the computer software or other technologies used in the operation of these Websites or services except while you are using the Website and Services in accordance with this Agreement.

  

7. You expressly confer jurisdiction on the province of BC and hereby agree, in the event of any dispute, any suit will be filed only in the province of BC, Canada.

  

8. Account Information:

  

a. To create an account and to use certain portions of the Website and Services, you will be required to provide specific and accurate information. You herby authorize MES to use, retain, and disclose the information you provide as we consider necessary, to provide Services to you. You represent and warrant that all information you provide is true, accurate, current and complete, and you will update the information so that it will remain true, accurate, current and complete. MES relies on the information you provide.

  

b. You are solely responsible and liable for all loss, damage, and additional costs that you, MES, or any other person may incur as a result of my submission of any false, incorrect, or incomplete information, or any breach of this Agreement.

  

c. MES is not under any obligation to verify the truth, accuracy, currency, or completeness of any information you provide, but MES may do so at their discretion. You consent that MES may make reasonable inquiries and investigations that we consider appropriate to verify the information you provide to us. MES reserves the right to suspend or terminate User Club accounts at our discretion. MES may suspend or deactivate User Club accounts if you provide MES with inaccurate or incomplete information.

  

9. You may terminate your participation in the User Club program at any time upon delivery of an email to notice to our support department at the following address: support@hgemarine.com

  

10. Any unauthorized access to or interference with the User Club program (including without limitation any electronic or non-electronic tampering, unauthorized intervention, fraud, or any other cause that corrupts or interferes with the administration, security, integrity, fairness, or proper conduct of the User Club program, or the use of any automated, programmed, falsified, or similar entry device or program) is strictly prohibited and may be a violation of criminal and civil laws. MES may cancel/suspend or require a refund of all rebates arising from an account that MES reasonably suspects is involved in or has benefited from any such misconduct.

   

11. You release and forever discharge MES and its employees and related persons from any and all claims, counterclaims, complaints, causes of action, liabilities, and obligations of any nature or kind, whatsoever and however arising, which now or hereafter arise directly or indirectly from or related to, the User Club program.
